Terms of Service

1. Who we are
UnderBreath ("we", "us", "our") is a private online community for mothers, operated from France. By creating an account or joining the waitlist, you ("you", "member") agree to these Terms of Service ("Terms") and our Privacy Policy and Community Guidelines.
If you do not agree, please do not use UnderBreath.
2. Who can join
UnderBreath is intended for adults aged 18 or over who are mothers, expecting mothers, or caregivers in a maternal role. You must provide accurate information when registering and you are responsible for keeping your account secure.
We reserve the right to refuse membership, suspend accounts, or remove members at our discretion, including where we believe membership criteria are not met or where behaviour is incompatible with the spirit of the community.
3. Your content
You keep ownership of everything you post. By posting on UnderBreath, you grant us a non-exclusive, worldwide, royalty-free licence to host, display, and distribute your content within the platform for the purpose of operating the service. This licence ends when you delete your content, except for copies that may remain in backups for a limited period or where retention is required by law.
You confirm that anything you post is yours to share, does not infringe anyone else's rights, and complies with our Community Guidelines.
4. Acceptable use
You agree not to:
- Post content that is illegal, harassing, hateful, threatening, or sexually explicit
- Share identifying photos, names, or personal information of children (yours or others)
- Provide medical, legal, or financial advice as a professional unless qualified, or in a way that could mislead
- Screenshot, record, copy, or share content from private circles outside the platform
- Reveal another member's real identity, location, or other private information ("doxxing")
- Spam, advertise, promote products, recruit for businesses, or solicit members
- Impersonate another person, including other members or the founder
- Scrape, copy, or reproduce the platform, our content, or other members' content
- Interfere with the security or normal operation of the service
Violation of these rules may result in content removal, warnings, suspension, or permanent removal from UnderBreath, at our sole discretion. Serious violations may be reported to the relevant authorities.
5. Moderation and enforcement
We may remove any content or account at any time, with or without notice, where we believe these Terms or our Community Guidelines have been broken, or where content poses a risk to members or to the platform.
We are not obliged to monitor all content, but we act on reports promptly. If you see content that breaks the rules, please use the in-app report function or email founder@underbreath.com.
6. Intellectual property
The UnderBreath name, brand, logo, design, illustrations, written copy, and software are owned by us and protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the platform without our written permission.
7. Copyright complaints
If you believe content on UnderBreath infringes your copyright, please contact us at founder@underbreath.com with: (a) a description of the work; (b) a link to where it appears on UnderBreath; (c) your contact details; (d) a statement that you believe the use is unauthorised; and (e) a statement that the information is accurate. We will review and remove infringing content where appropriate.
8. Disclaimers
UnderBreath is a peer community, not a medical, legal, or professional service. Anything shared by members is personal opinion and lived experience, not professional advice. Always consult a qualified professional for medical, mental health, legal, or financial questions.
The service is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties about the platform's availability, accuracy, or suitability for any purpose.
9. Limitation of liability
To the fullest extent permitted by law, UnderBreath, its founders, and team are not liable for any indirect, incidental, or consequential damages arising from your use of the service or content posted by other members. Nothing in these Terms limits liability that cannot be limited under French or EU law.
10. Termination
You may close your account at any time. We may suspend or terminate your access at any time for breach of these Terms or at our reasonable discretion. Sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, governing law) will survive termination.
11. Changes to these Terms
We may update these Terms from time to time. If changes are material, we will notify members by email or in the app at least 14 days before they take effect. Continued use after changes take effect means you accept the updated Terms.
12. Governing law and jurisdiction
These Terms are governed by the laws of France. Any dispute will be brought before the competent courts of Paris, France, except where applicable consumer protection law gives you the right to bring proceedings in your country of residence, or before the courts of the place where you are domiciled.
In line with French consumer law (Code de la consommation, art. L.612-1 et seq.), if a dispute cannot be resolved by contacting us directly, EU consumers may refer the matter to a consumer mediator. As UnderBreath is free during early access and no purchase is offered, this provision applies only once paid services are introduced; a designated mediator will then be named in this section.
13. EU Digital Services Act (DSA)
In compliance with Regulation (EU) 2022/2065 (Digital Services Act), our single point of contact for users, authorities of EU Member States, the European Commission, and the European Board for Digital Services is: founder@underbreath.com. Communication may be made in English or French. Notices about illegal content can be sent to the same address and will be acknowledged and acted on promptly. Where we remove or restrict content or an account, the affected member receives a clear statement of reasons and may appeal through our internal complaint-handling procedure (see our Community Guidelines).
